Nursing Home Neglect Blamed for Resident’s Fatal Fall in Duluth Facility

February 15, 2011 – Duluth, Minn. – According to reports from the Duluth News Tribune, nursing home neglect has been blamed for a resident’s fall at the Benedictine Health Center. The female resident suffered significant and ongoing pain after the fall, and it is believed that the injuries suffered at that time contributed to her death less than 2 weeks later.  After an investigation from the Minnesota Department of Health, it was found that this resident—who suffered from a number of health ailments, including Parkinson’s disease, dementia, a stroke and osteoarthritis—fell while being moved from her bed to a bathroom due to nursing home neglect from a staff employee.  The staff employee admitted that while transferring the resident she failed to use a buttock strap that was necessary because the resident had paralysis on the left side of her body and required significant assistance.

As part of her care plan, the resident was to be transferred using a mechanical lift, which includes the use of a vest, straps for the lower legs and a buttock strap.  As a result of the fall she suffered contusions on her head and left hip. The pain and decreased movement continued, along with her loss of appetite.
