Build-a-Bear Pays $600,000 Penalty for Failing to Report a Toy Defect

According to Business Week, toy company Build-a-Bear has agreed to pay a $600,000 civil penalty after failing to report a toy defect.  This comes as a result of a defect in the toy bear beach chair, which has sharp edges on the folding wood frame. This could lead to lacerations or even the amputation of a fingertip.  The beach chairs were sold in stores and online from March 2001 through Oct. 2008. Between July 2007 and Jan. 2009, they received 10 injury reports. However, they failed to report these immediately to the U.S. Consumer Product Safety Commission (CPSC). It wasn’t until March 2009 that the CPSC was finally made aware of the problem.  When a manufacturer, distributor or retailer becomes aware of a defect in a product, they must report it to CPSC within 24 hours of learning about the defect. While Build-a-Bear did issue a recall on the product, they still must pay the civil penalty for their delay in reporting the defect.  Product defects can lead to serious, even fatal injuries.
