Strict Liability Lawsuit against Makers of Mirapex Denied

January 20, 2011 – According to a report on Leagle, a strict liability lawsuit against the makers of Mirapex has been denied. Adverse side effects in one patient, Anthony Scelta, resulted in the lawsuit against the companies that manufacture and sell Mirapex.  These companies include:

  • Pharmacia & Upjohn Co., LLC;
  • Pharmacia Corp., Pharmaceuticals, Inc.; and
  • Pfizer, Inc.

Scelta, who had been diagnosed with Parkinson’s disease, was prescribed Mirapex to alleviate his symptoms. He alleged that after taking Mirapex, he began to experience changes in his behavior, including compulsive spending and hypersexual feelings.  He further alleged that as a result of these changes in behavior, he experienced financial loss and divorce. Despite using specialist testimony, he was unable to prove that the manufacturer and makers of Mirapex had been negligent.

Scelta contended that deceptive trade practices and advertising were the basis for his claim, along with fraudulent misrepresentation and concealment. While he did not win this strict liability lawsuit, Scelta plans to appeal the decision.    A strict liability claim can be a complicated type of case to pursue.
