Families File $2 Million Lawsuits against Nursing Home

December 9, 2010 – Hermiston, OR – The families of 2 deceased nursing home patients are suing the home for more than $2 million dollars in total damages, HermistonHerald.com has reported.  The first patient, S. Dean Gardener, 70, was a resident at Regency Hermiston from September 8, 2009, to January 1, 2010. During that time, he incurred several wounds on his left foot that subsequently became infected.  Gardener was taken to the emergency room at Good Shepherd Medical Center on January 1, 2010. He underwent surgery at Good Shepherd and was then taken to Willowbrook Terrace, where he died on February 24, 2010.  Gardener’s family is seeking $776,890 in damages. In Regency’s reply to the complaint, the company claimed no wrongdoing.  The second patient, Maxine Monaghan, 89, was admitted to Regency on May 13, 2008. Nine months into her stay, Monaghan suffered a “significant fall” while she was supposed to be in the care of nursing home staff. She was also treated at Good Shepherd and returned to Regency.  About 4 months later, Monaghan suffered another fall. She was treated for spine and nasal fractures at Good Shepherd. She was then returned to Regency, where she died 3 weeks later.  In their complaint, Monaghan’s family claimed that the staff of Regency failed to “adequately assess Mrs. Monaghan’s risk for falls,” and respond with appropriate preventive measures. The family is seeking $1.25 million in damages.  The families of both Gardener and Monaghan are claiming 3 counts of negligence and a fourth count of wrongful death.
