$15 Million Settlement Reached in Long Island Missed Diagnosis of Breast Cancer

According to NBC New York a $15 million settlement was reached in a missed diagnosis of breast cancer.  Stephanie Tesoriero, 50, of Long Island, was just awarded this settlement stemming from a marble-sized lump that was found in her breast back in 2002. At the time her physician, Dr. Paul Fisher, working out of Carol M. Baldwin Breast Care Center, indicated further tests weren’t necessary because there was no evidence to suggest it was malignant. Tesoriero was told to come back in 1 year. Sixteen months later, when she was examined by another doctor, it was discovered that the tumor had grown to the size of a golf ball. Following her diagnosis she underwent chemo, radiation, and a mastectomy.  However, all of this could have been avoided if Dr. Fisher had run further tests to rule out whether the lump was cancerous or not. On Wednesday, February 8, he was found negligent. Although Tesoriero’s cancer went into remission, it has not only returned but it has now spread to her bones. The missed diagnosis prevented her from receiving early treatment which may have changed the entire outcome.
