U.S. Supreme Court Denies Pfizer Prempro Appeal

The U.S. Supreme Court denied Wyeth’s appeal (a Pfizer unit) of a $58 million award made to three Nevada women who claim they developed breast cancer after taking Prempro and Premarin, which are both hormone replacement drugs used for menopause.

Arlene Rowatt, Pamela Forrester, and Jeraldine Scofield took these drugs and developed breast cancer. In 2007 they were originally awarded $134.1 million, but this amount was later reduced to $57.6 million by the trial judge. Lawyers for Pfizer wanted the trial court to order a new trial instead of reducing the award, because they believed the jury was swayed by an “improper and inflammatory” closing argument by one of the lawyers representing these women.

Wyeth made in excess of $2 billion annually in hormone-replacement drugs such as Prempro and Premarin before a 2002 study linked these medications to a 24 percent increased risk to developing breast cancer.

Over 6 million women took Prempro and Premarin before this study, and Pfizer has set aside $772 million to cover settlements with the 10,000+ claims against their company.
