Juan M. Ramirez was diagnosed with inflammatory bowel disease shortly after his June 1, 1992 birth as the result of his father’s ingestion of Accutane in the mid-1980′s. Ramirez says he “has suffered, and in all probability, will continue to suffer for the rest of his life, the debilitating consequences of the autoimmune disorder commonly called Chron’s Disease.” During the time Ramirez’ father was prescribed Accutane, the drug’s warning labels were insufficient as to the “dangerous risks and reactions” associated with the drug. “Roche provided defective, inaccurate, and misleading labeling, including failure to warn that Accutane causes the side effects mentioned herein, rather than merely being associated with them, thereby improperly concealing the causal nexus between the product and its side effects,” Ramirez charges.
Ramirez alleges that Accutane manufacturers Hoffman-La Roche Inc. failed to warn that Accutane “can cause permanent systemic damage which will not subside with discontinuation of its use; can cause harm to an unborn child via use by either parent; can cause symptoms to appear long after use is discontinued, and in the offspring of the user’ causes harmful consequences and systemic damage when it is used long-term.” Ramirez also claims that Roche conducted “insufficient studies” in regards to the safety and efficacy of Accutane, and that prior studies linked Accutane use to adverse reactions. Roche knew or should have known about these studies, tests and reports, Ramirez alleges. The suit, which was removed to the U.S. District Court for the Southern District of Texas, sets forth claims of strict liability and negligence.
