What Are the Details of the Takata Recall and Class Action Lawsuits?

In 2002, the Takata Corporation, a Japanese airbag maker, in a money-saving move, replaced a safe compound in its airbags with a cheaper, unproven alternative. The new ammonium nitrate, used with a desiccant (i.e., drying agent), compound turned out to be volatile, with the potential to cause violent deployments of the airbag, sometimes unprompted by any collision or impact.

Executives from Takata Corporation later acknowledged having had concerns about the safety of the new compound at the time of implementation. But in service of saving money, they forged ahead anyway, and as a result, lives have been lost and severe injuries have occurred.

The multiple class action lawsuits against Takata allege loss of life, severe injury, and property damage. Certain automakers, including Toyota, have also gotten swept up in the suits, and as a result have pledged billions of dollars toward settling them.

What Should I Do if My Car Is on the List?

If your car is on the list but you have not been injured yet, take your car to get serviced immediately. If your car is on the list and you have been injured (or your loved one was injured or killed), an attorney from Gacovino, Lake & Associates, P.C. can go over your legal options.

If your car is not on the list but you believe a faulty Takata airbag caused your injuries, you can still call us. The list is ever-expanding, with automakers adding cars frequently. Also, your vehicle does not need to be on any official list for us to win compensation for your injuries. If we can prove a faulty airbag was the cause, we can win a defective product claim and get you paid.

What Damages Might I Be Eligible For?

The circumstances of your case determine the type of claim we file and the damages you might be eligible to receive. The team at Gacovino, Lake & Associates, P.C. often wins a combination of economic and noneconomic damages for our clients in personal injury cases.

Economic damages consist of losses we can quantify in dollar terms. For instance:

  • The costs of your current and anticipated future medical bills;
  • The wages you have missed out on due to your inability to work while recovering from your injuries;
  • Your reduced ability to earn a living because of long-term effects from your injury;
  • The value of all personal property lost.

We also go after noneconomic damages, which are more subjective in nature and might include compensation for your pain and suffering, emotional anguish, and loss of consortium.

If your loved one died from a defective Takata airbag, we might be able to pursue a wrongful death lawsuit as well.
