Court of Appeals in San Francisco Reinstates Ibuprofen Lawsuit

February 3, 2011 – According to the San Francisco Chronicle, a San Francisco court of appeals has “revived” a lawsuit against a manufacturer of ibuprofen. The court ruled that makers of generic drugs may be sued for failing to provide adequate warnings about their drugs.   The lawsuit alleged that Perrigo Pharmaceuticals Co., an ibuprofen manufacturer, failed to warn consumers that ibuprofen, when taken with other drugs, may lead to liver and kidney damage.  The original lawsuit was filed by Margaret Gaeta after her 10-year-old son suffered adverse effects from Perrigo Pharmaceutical’s ibuprofen. The boy was hospitalized with septic shock, liver failure, and kidney failure after taking ibuprofen for post-surgical pain. As a result, the boy underwent a liver transplant, and parts of his fingers and toes had to be amputated. The lawsuit also alleged that the boy now suffers from depression.
