Wrongful Termination

In many states, employees are hired on at at-will basis, meaning that they do not enter into a contract simply by accepting a job. This no-contract agreement allows either the employer or the employee to terminate the working relationship at any time for any nondiscriminatory reason. However, sometimes employers abuse this law, using it as an excuse to fire an employee whom they have no other justifiable reason to terminate. For example, an employee who reports sexual harassment may be labeled a “troublesome employee” and let go by reason of the no-contract agreement law, when in fact the company wanted to fire that person to avoid further problems. In other cases, a company may unfairly remove an older employee and replace him or her with a younger, new employee. No matter the type, wrongful termination is punishable by law.
